Cigna can’t dodge TCPA Suit on dental marketing calls

By Allison Grande (July 28, 2022, 10:28 p.m. EDT) – A federal judge in Maryland has refused to release Cigna from a proposed class action lawsuit regarding allegedly illegal dental discount plan robocalls placed by a marketing vendor, rejecting the insurer’s argument that it did not have sufficient ties to the state.

U.S. District Judge Catherine C. Blake declined to drop the insurer from the lawsuit on Wednesday, finding that Connecticut-based Cigna Health and Life Insurance Co. had “deliberately exercised the privilege of conducting business in the Maryland” and that the alleged Consumer Telephone Privacy Act violations were correctly linked to Cigna’s contacts in the state.
